Terms of Service

These Terms of Service ("Terms") govern your access to and use of Chatrypt's mobile application, website, and all related services (collectively, the "Services"), provided by Chatrypt ("Company", "we", "us", or "our").

By creating an account or using any part of the Services, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference.

To use Chatrypt, you must meet the following eligibility requirements:

• Be at least 13 years of age (or the minimum age required in your jurisdiction)
• Have the legal capacity to enter into a binding agreement
• Not be prohibited from using the Services under applicable law
• Not have had a previous account terminated by Chatrypt for violations

If you are between 13 and 18 years old, you must have your parent or legal guardian's consent to use the Services.

When creating an account on Chatrypt, you agree to:

• Provide accurate and complete registration information
• Keep your login credentials confidential and not share them with others
• Immediately notify us of any unauthorized access to your account
• Be responsible for all activities that occur under your account
• Use only one account per person unless expressly permitted

Chatrypt offers both free and premium subscription tiers. The following terms apply to paid subscriptions:

Billing:

• Subscription fees are billed in advance on a recurring basis (weekly, monthly, or annually).
• Payments are processed through Google Play or Apple App Store according to their respective billing policies.
• All prices are displayed inclusive of applicable taxes in your region.

Free Trial:

• Free trials, when offered, automatically convert to paid subscriptions unless cancelled before the trial period ends.
• Only one free trial is permitted per user per subscription plan.

Cancellation & Refunds:

• You may cancel your subscription at any time through your app store account settings.
• Cancellation takes effect at the end of the current billing period; you retain access until then.
• Refunds are governed by the refund policies of Google Play and Apple App Store.
• We do not issue direct refunds except where required by applicable law.

Price Changes:

• We reserve the right to modify subscription prices with reasonable advance notice.
• Continued use after a price change constitutes acceptance of the new pricing.

Chatrypt's AI-powered features are provided for personal, lawful use only. By using AI features, you agree that you will not:

• Use AI features to generate harmful, illegal, defamatory, or abusive content
• Attempt to manipulate, jailbreak, or circumvent AI safety measures
• Use AI outputs for misinformation, impersonation, or fraud
• Scrape, reproduce, or commercially exploit AI-generated content without authorization

AI credit usage is subject to fair-use limits based on your subscription tier. Excessive or abusive API usage may result in throttling or account suspension.

You agree not to engage in any of the following activities when using Chatrypt:

Violation of these prohibitions may result in immediate account suspension or termination at our sole discretion.

The Chatrypt application, including its source code, design, graphics, user interface, features, and branding, is the exclusive intellectual property of Chatrypt and is protected by applicable copyright, trademark, and other intellectual property laws.

We grant you a limited, non-exclusive, non-transferable, revocable license to use the application for personal, non-commercial purposes in accordance with these Terms. You may not:

• Copy, modify, or create derivative works of the application
• Redistribute, sell, or sublicense the application or its components
• Remove or alter any proprietary notices or labels
• Use our trademarks, logos, or brand assets without prior written consent

You retain ownership of any content you create or share through the Services ("User Content"). By submitting User Content, you grant Chatrypt a worldwide, royalty-free, non-exclusive license to use, store, and display your content solely for the purpose of operating and improving the Services.

You represent and warrant that:

• You own or have the necessary rights to share the User Content
• Your User Content does not infringe any third-party intellectual property rights
• Your User Content complies with these Terms and all applicable laws

Chatrypt reserves the right to remove any User Content that violates these Terms or is otherwise deemed inappropriate, without notice.

Disclaimer of Warranties:

The Services are provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or entirely secure.

Limitation of Liability:

To the maximum extent permitted by applicable law, Chatrypt and its affiliates, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or in connection with your use of the Services.

Either party may terminate the agreement formed by these Terms at any time:

• By you: You may stop using the Services and delete your account at any time through the app settings.
• By us: We may suspend or permanently terminate your access if you violate these Terms, engage in fraudulent behavior, or for any other reason at our discretion, with or without notice.

Upon termination, your license to use the Services ends immediately. Sections 7 (Intellectual Property), 9 (Disclaimers), and 11 (Governing Law) survive any termination.

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law provisions. Any disputes arising from or relating to these Terms or the Services shall be resolved through good-faith negotiation. If negotiation fails, disputes shall be submitted to binding arbitration or competent courts as required by law.

You agree that any claim must be brought individually and not as part of a class action. Chatrypt reserves all rights to seek injunctive relief in any jurisdiction.

We reserve the right to modify these Terms at any time. When changes are made:

• The "Last updated" date at the top of this page will be revised
• For material changes, we will notify you via in-app notification or email at least 14 days in advance
• Your continued use of the Services after the effective date of changes constitutes acceptance of the updated Terms

If you do not agree with the updated Terms, you must stop using the Services and delete your account.
